WHAT ARE FUNDAMENTAL RIGHTS?

These rights are meant for promoting the ideal of political democracy. Fundamental Rights are guaranteed by the constitution to all persons without any discrimination. They uphold the equality of all individuals, the dignity of the individual, the larger public interest and unity of the nation. In fact, the Fundamental Rights in our constitution are more elaborated than those found in the constitution of any other country, including the USA.

CONCEPT ARRIVED

The concept of fundamental rights is arrived from U.S. Constitution drafted in 1787. The U.S. Constitution was the first modern Constitution to give shape to the concept of human rights by putting them into the Constitution and making them justiciable and enforceable through the instrumentality of the courts.
